Certificate of Lawful Use

Also sometimes referred to as Certificate of Lawful Use or Development or CLUED for short.

Where a property has had changes made to it that require planning permission (and not all changes do) this should have been sought from the local council before the changes were made.

Changes are usually one of two types:

  • Physical change - an extension was added of the size that should have planning permission. This is covered in the 'Development' part of the certificate.
  • Use change - say an agricultural building was changed to commercial use. This is covered in the 'Lawful Use' part of the certificate.

Its basically retrospective planning permission. The success of doing this depends on a number of factors covered in my ebook How to Really Buy a Property.
